What is the legal basis for processing your personal information?

Once you have consented to a referral we do not rely on that consent to use your information as a 'legal basis for processing'. We rely on the fact that your employer has a legitimate interest in providing an Occupational Health Service to its employees. In relation to such a service it is necessary to process medical information for the purposes of preventive or occupational medicine, or for the assessment of the working capacity of an employee.

However, you do have the right to say 'NO' to our use of your information but this could have an impact on our ability to provide our services.

We do not share your information with any other person without your explicit consent or where we have an overriding legal obligation. Examples of this are:

  • If there is a concern that you are putting yourself at risk of serious harm
  • If we have been instructed to do so by a Court
  • If the information is essential for the investigation of a serious crime
  • If your information falls within a category that needs to be notified for public health or other legal reasons, such as certain infectious diseases

The information from your patient record will only be used for purposes that benefit your care – we would never share it for marketing or insurance purposes.
